Privacy Notice

Important: This notice applies to the Verifiction application, platform and related Services. Verifiction's public marketing website is also subject to a separate Cookie Policy describing analytics, advertising and other website technologies.

1. Introduction

Verifiction Technologies Inc. ("Verifiction," "we," "us," or "our"), a company incorporated in British Columbia, Canada, operates the Verifiction application, platform, website, hosted application programming interfaces ("APIs"), URL-based retrieval features and related media-authenticity and detection services (collectively, the "Services"). Please read this Privacy Notice carefully. It explains what Personal Information and customer-submitted content we collect and process, what the Services do with that information, how information may be disclosed or retained, and the choices and rights that may be available to you. By accessing or using the Services, creating an account, enabling an integration, or submitting content for analysis, you acknowledge that you have read and understood this Privacy Notice. Where consent is required by applicable law, we will request consent in an appropriate manner. If you have questions about our privacy practices, please see Section 16, "Contact Information."

2. Scope

For purposes of this Privacy Notice, "process," "processed," or "processing" means any operation performed on Personal Information or customer-submitted content, whether by automated means or otherwise, including collection, recording, organization, structuring, storage, transmission, retrieval, consultation, analysis, comparison, use, disclosure, restriction, deletion or destruction. This Privacy Notice applies to information we process: through the Verifiction application, account portal, dashboard or other authenticated Services; through APIs, URLs, webhooks or other customer-enabled integrations; when a customer or user uploads, submits, transmits or directs us to retrieve images, video, audio, documents or other content for analysis; through communications with Verifiction by email, forms, support channels or otherwise; and on behalf of our customers in connection with the Services, as described separately in Section 13. Verifiction generally acts as a controller or equivalent responsible organization for account, billing, security, support, website and business-relationship information that Verifiction determines how and why to process. When Verifiction processes customer-submitted Personal Information solely to provide the Services requested by a customer, Verifiction generally acts as a processor, service provider, contractor or equivalent acting on that customer's instructions. Verifiction's public marketing website may use analytics, advertising or marketing technologies described in Verifiction's separate Cookie Policy. This Privacy Notice describes Verifiction's standard practices. Where an enterprise customer has entered into an Order Form or Data Processing Agreement that varies a specific practice described here, that agreement governs for content submitted under it, and the customer is responsible for providing any notice required to the individuals concerned.

3. The Data We Collect and Process

"Personal Data" or "Personal Information" means information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with an identifiable individual. It does not include information that has been lawfully anonymized or aggregated so that it can no longer reasonably identify an individual. Depending on how the Services are used, we may process the following categories:

Data We Generally Collect and Process as a Controller

Identity and Account Data

Name, username, account identifier, role, company or organization, account status and related account information. Authentication identifiers, tokens and related account-security information. Authentication may be handled through a contracted authentication provider. We do not store raw account passwords in readable form.

Contact Data

Email address, telephone number, mailing address, billing address and business contact details.

Transaction and Billing Data

Details of products or Services purchased, credit purchases, Order Form details where applicable, usage, invoices, payments and failed payments. Payment-card information may be collected directly by a contracted payment processor. Where this occurs, we do not receive or store the full payment-card number, expiration date or security code.

Technical, Security and Usage Data

IP address, device and browser characteristics, user agent, operating system, access times, request identifiers, security events, error logs and information about how the Services are used. A record of checks performed by an account, associated Results, usage quantities, account activity and billing-related usage.

Communications and Support Data

Information you provide through forms, email, support requests, surveys or other communications with us. We may create de-identified or aggregated information that does not reasonably identify an individual. We may use such information for analytics, security, capacity planning, quality control, business operations and other lawful purposes.

Customer Data We Generally Process as a Processor or Service Provider

Submitted Media, URLs and Authenticity Information

Images, video, audio, documents, files, prompts, instructions, URLs and other content submitted or made available for analysis. File metadata, technical attributes, content credentials, timestamps, filename, file size, duration and other information associated with submitted content. Submitted images may contain identity documents such as passports or driver's licences, which may include names, dates of birth, addresses, photographs, document numbers or other information visible in the image. Where supported, Verifiction assesses such an image only for synthetic-generation or visual-manipulation indicators. Verifiction does not validate the document, verify its security features, confirm the identity of the holder, or perform identity verification or fraud detection, and is not offered as an identity-verification service. Submitted photographs, video or audio may contain faces, voices, bodies or other identifiable characteristics. The Services may analyze facial, visual, audio, movement, lip-synchronization and other media characteristics solely to assess authenticity, detect manipulation or synthetic generation, identify compositing or face-swap indicators, and evaluate how media may have been created or altered. The Services are not a people-search, tracking or identity-verification service. Any internal comparison of facial or other media characteristics is used only for media-authenticity analysis. Results do not identify, name, locate or confirm the identity of a person depicted or heard in submitted content. To perform this analysis, the Services may temporarily generate derived technical representations, sometimes described as feature vectors, of facial, voice, visual or acoustic characteristics. These representations are used solely to assess authenticity, manipulation indicators or similarity within the media being analyzed. They are not used to identify, authenticate, locate or track any individual and are not compared against any database of individuals for identification purposes. Verifiction does not retain reusable facial-recognition templates, voiceprints or other biometric-identification templates after an analysis is completed, except where expressly agreed with an enterprise customer and permitted by applicable law.

Detection and Verification Results

A verdict or classification such as "real," "likely authentic," "fake," "AI-generated," "digitally manipulated," "uncertain" or another enabled result. Confidence scores, indicators, labels, flags, reports, heatmaps, summaries, explanations and other information generated by the Services. The primary Result may provide a likelihood or confidence classification. Where a customer purchases or enables a higher-tier analysis, the Result may also include deeper technical findings about the apparent method of creation or manipulation. These findings may identify the general category of technology believed to have been involved, such as generative image tools, face-swapping technology, voice-cloning systems, synthetic-video generation or editing software. Where the analysis produces sufficient confidence, the findings may also identify one or more likely tools or providers. Such findings are probabilistic and do not guarantee the exact tool, service or person responsible. Results are analytical and probabilistic assessments and may contain false positives, false negatives, incomplete findings, inaccurate findings, uncertain classifications or other errors. Customers and users are solely responsible for independently reviewing and validating Results together with other available evidence before relying on them, disclosing them or taking any action based upon them, particularly where a decision may have legal, financial, employment, reputational, safety or other significant consequences.

4. The Sources from Which We Process Personal Information

We collect or receive Personal Information through: Direct interactions with you, including information you provide during registration, billing, support, account administration or when you submit your own content. Our customers, customer administrators, authorized users, end users or customer-controlled systems, including information a customer submits about another individual or directs us to process on the customer's instructions. The Services, including direct uploads, URLs, APIs, webhooks and other integrations. Contracted providers used for authentication, hosting, storage, computing, email delivery, payments, security and customer support. Third-party sign-on or linked services, if enabled and selected by the user. When a customer directs Verifiction to retrieve content from a URL or connected system, we may receive the content and associated information from the location identified by the customer. The customer is responsible for having the lawful authority to direct that retrieval and processing.

5. Purposes for Which We Process Your Personal Information

We process Personal Information for the following purposes:

Provision of the Services

Create and manage accounts, authenticate users, provide access to features and maintain account security. Receive, retrieve, store, transmit and analyze submitted content and produce the requested Results. Assess whether submitted media or documents appear authentic, AI-generated, synthetically generated, digitally altered, manipulated, composited or uncertain. Where enabled, provide deeper technical indicators about the apparent generation, editing or manipulation method or workflow, without identifying or verifying the identity of a person depicted or heard in the media. Provide APIs, URL retrieval, customer integrations and customer-configured webhooks. Measure usage, apply plan limits, calculate charges, process billing and maintain service records. Detailed descriptions of the Services, their limitations, the meaning of Results and required human review are provided in the Verifiction Terms of Use and Services Agreement. The Services generate Results through automated analysis. Verifiction does not itself make decisions producing legal effects, or similarly significant effects, concerning individuals. Results are supplied to customers as probabilistic analytical inputs, and customers are required under the Terms of Use and Services Agreement to apply meaningful human review before taking any decision with legal, financial, employment, reputational, safety or similarly significant consequences for an individual. Where applicable law confers rights in relation to automated decision-making, including the right to obtain human intervention, to express a point of view and to contest a decision, those rights may be exercised against the customer that made the decision, and Verifiction will provide that customer with reasonable assistance in responding.

Customer Management and Communications

Manage customer accounts, provide customer support and respond to requests. Send account invitations, authentication messages, password-reset messages, service notices, security notices and other transactional communications.

Marketing Communications

Send marketing communications where permitted by law and based on any consent required. Users may unsubscribe from promotional messages.

Security, Compliance and Business Operations

Diagnose and fix technical issues, monitor system performance, prevent fraud and abuse, and protect the Services, users and third parties. Enforce our Terms, service agreements and policies, collect amounts owed and comply with legal, regulatory, tax, accounting, audit or litigation obligations. Create de-identified or aggregated information for internal analysis, quality assurance, research, service planning and other lawful purposes.

6. Our Lawful Bases and Consent Framework under Canadian and European Privacy Law

Canada Where Canadian privacy law applies, we collect, use and disclose Personal Information with meaningful consent, except where processing without consent is authorized or required by law. We identify the purposes for which information is processed and limit collection, use, disclosure and retention to purposes that a reasonable person would consider appropriate in the circumstances. You may withdraw consent to processing that is based on consent, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent will not affect processing that lawfully occurred before withdrawal and may prevent us from providing some or all of the Services. European Economic Area, United Kingdom and Switzerland Where applicable, we may rely on one or more of the following legal bases: Consent, including explicit consent where required for sensitive information. Performance of a contract, including providing the Services requested by you or a customer. Compliance with legal obligations, including obligations connected with civil, criminal, corporate, taxation, regulatory or litigation matters. Our legitimate interests or those of a third party, where those interests are not overridden by applicable rights and interests, including security, fraud prevention, service administration and protection of legal rights. When Verifiction processes Personal Information on behalf of a customer, the customer is responsible for establishing the lawful basis and providing required notices or obtaining required consent.

7. Disclosure of Your Personal Information

We do not sell, rent or loan customer-submitted media or Results to data brokers or independent third parties. We may disclose Personal Information only as described below and as permitted or required by law:

  • Within Our Corporate Group We may disclose Personal Information to Verifiction affiliates or related entities where reasonably necessary to operate, secure, support, finance or administer Verifiction and the Services. Contractors and Service Providers We may use contracted providers for hosting, cloud storage, computing, authentication, transactional email, payment processing, customer support, security, communications and other functions necessary to provide the Services. Providers may access only the information reasonably necessary to perform their contracted functions and are subject to confidentiality, security and data-processing obligations where required. Customer-Directed Integrations and Webhooks If a customer configures a webhook or another integration, we may transmit limited status or account-activity information, Results or other information selected or authorized by the customer to the system controlled by that customer. Information sent to a customer-controlled system is then governed by the customer's practices and agreements. Other Organizations at Your or the Customer's Instruction You or the customer may direct us to share Results or other information with another organization. Once information is disclosed at that direction, the recipient's privacy practices apply. We are not responsible for an independent recipient's use or security of information. Third-Party Sign-On and Linked Services If you elect to use a third-party sign-on or linked service, that provider may receive information about your use of the connection. Its own terms and privacy practices govern its processing. Legal, Safety and Regulatory Disclosures We may access, preserve or disclose information where we reasonably believe it is necessary to comply with law, legal process, national-security or law-enforcement requests
  • protect rights, property or safety
  • enforce contracts or policies
  • collect amounts owed
  • or investigate suspected unlawful activity. Corporate Transactions Information may be disclosed or transferred in connection with a merger, acquisition, financing, reorganization, sale of assets, insolvency or similar transaction, subject to applicable law and continuing privacy obligations.

8. Cookies and Automatic Data Collection Technologies

The authenticated Verifiction application may use essential and functional cookies or similar technologies for authentication, account security, session management, fraud prevention, preferences, load balancing and core functionality. Verifiction's public marketing website may use essential, functional, analytics, advertising or marketing cookies, pixels, web beacons and similar technologies. These technologies, the categories used, available consent choices and instructions for changing preferences are described in Verifiction's separate Cookie Policy and Cookie Settings tool. Cookie choices on the public website may not control technologies used in the authenticated application, and vice versa. You can usually configure your browser to block or delete cookies, although some essential features may not function properly if essential cookies are disabled.

9. Your Choices About How We Collect, Use and Disclose Your Personal Information

You may choose not to provide or submit information. However, Verifiction cannot perform an analysis without receiving the content and information required for the selected Service. Do not upload, submit, connect or direct us to retrieve content if you do not agree to the processing described in this Privacy Notice. You may manage available cookie categories through Verifiction's Cookie Settings tool and may use browser or device controls to manage cookies and similar technologies. You may unsubscribe from promotional emails using the unsubscribe link in the message. We may continue to send service, security, billing, account and legal communications that are necessary to administer the Services. Customers may disable or change their own webhooks and integrations through available settings or by contacting support. Customers remain responsible for information already sent to systems they control.

10. Transfers of Your Personal Information to Other Countries

Personal Information and customer-submitted content may be processed outside your province, territory or country through related entities or contracted providers. Information processed in another jurisdiction may be subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement agencies or governmental authorities there. Where Canadian privacy law applies, Verifiction remains accountable for Personal Information transferred to a service provider for processing and uses contractual, technical and organizational measures designed to provide an appropriate or comparable level of protection. Where European transfer restrictions apply, we will use an appropriate transfer mechanism required by applicable law.

11. Retention of Personal Information

We retain Personal Information only for as long as reasonably necessary to fulfil the purposes for which it was processed, including providing the Services and satisfying legal, accounting, reporting, security, fraud-prevention, audit, dispute-resolution and enforcement requirements. To determine an appropriate retention period, we consider the nature and sensitivity of the information, the purposes for processing it, the risk of harm from unauthorized use or disclosure, whether the purpose can be achieved through another means, customer instructions, contractual requirements and applicable law. Account, billing, support, security, audit and legal records may be retained for different periods based on those purposes. Retention of customer-submitted media and associated Results is described in Section 13. When Personal Information is no longer required, we will delete, destroy or de-identify it in accordance with applicable law and our retention and disposal procedures. Limited information may remain where reasonably required by law, security, fraud prevention, billing reconciliation, dispute resolution or backup processes.

12. Your Rights Related to Your Personal Information

Subject to applicable law, you may have rights regarding Personal Information, including:

  • the right to request confirmation of whether we process Personal Information about you
  • the right to request access to Personal Information under our control and information about how it is used or disclosed
  • the right to request correction of inaccurate or incomplete Personal Information
  • the right to withdraw consent where processing is based on consent, subject to legal and contractual limitations
  • where applicable, the right to request deletion, restriction, objection or data portability
  • and the right to challenge our compliance or file a complaint with an applicable privacy regulator. the right to appeal a decision we make about a request, and to challenge our compliance or file a complaint with an applicable privacy regulator. To exercise a right, contact support@verifiction.com. We may request information necessary to verify your identity and authority. Canadian access requests will ordinarily be answered within 30 calendar days. Other jurisdictions may prescribe different response periods. Where applicable law permits an extension of the response period, we will inform you of the extension and the reason for it within the original period. If we decline a request in whole or in part, we will explain the basis for that decision and how you may appeal it or complain to the applicable privacy regulator. If Personal Information was submitted by a Verifiction customer, please contact that customer first. Verifiction generally acts on the customer's instructions and will provide reasonable assistance where required.

U.S. State Privacy Rights and Choices

Residents of certain U.S. states may have rights to know, access, correct, delete or receive a portable copy of Personal Information, to opt out of certain sales, sharing, targeted advertising or profiling, and to appeal a decision regarding a rights request, subject to applicable law. Verifiction does not sell Personal Information, and does not share Personal Information for cross-context behavioural advertising, through the authenticated Verifiction application. Customer-submitted media and Results are never sold, shared or used for advertising. Verifiction's public marketing website may use analytics or advertising technologies as described in the Cookie Policy; where those technologies constitute a sale or sharing under applicable state law, you may opt out through the Cookie Settings tool. The categories of Personal Information we collect, the sources, the purposes for which it is processed and the categories of recipients – including for the preceding 12 months – are described in Sections 3, 4, 5 and 7. To submit a U.S. privacy request or appeal, email support@verifiction.com with the subject line "U.S. Privacy Rights Request" or "Appeal," as applicable. We may verify your identity or the authority of an authorized agent.

13. Customer Data Submitted to or Collected through the Services

Verifiction customers may electronically provide or transmit information to the Services for media-authenticity detection, synthetic-media detection, manipulation analysis, source or workflow analysis, or related purposes. Customer processing is also governed by the applicable Terms of Use and Services Agreement, service agreement, customer Order Form and, where applicable, Data Processing Agreement, including the customer's representations, warranties, indemnification obligations and the applicable disclaimers and limitations of liability.

Customer Responsibility and Contractual Allocation of Risk

The customer determines which information is submitted, why it is processed and how Results are used. The customer is solely responsible for complying with applicable laws; providing required notices; obtaining required consent, permissions, licences and releases; and maintaining all lawful authority necessary to submit or direct the processing of images, video, audio, documents, URLs and other content. A customer must not submit or direct Verifiction to retrieve information if it does not have the legal authority to do so. The customer is responsible for independently reviewing Results and for how it uses, discloses, distributes, publishes, interprets, relies upon or takes action based on Results after they are provided. The customer's representations, warranties, indemnification obligations and the applicable disclaimers, releases, exclusions and limitations of liability are set out in Verifiction's Terms of Use and Services Agreement, applicable service agreement, customer Order Form and other agreement governing the Services. This Privacy Notice does not limit, replace or reduce those contractual obligations.

Verifiction's Role

When Verifiction processes customer-submitted Personal Information solely to provide the Services requested by a customer, the customer generally acts as the controller, business or equivalent responsible party and Verifiction acts as the processor, service provider, contractor or equivalent. We do not maintain a direct relationship with many individuals whose information appears in customer-submitted content. Those individuals should direct privacy requests to the relevant customer. Verifiction will provide reasonable assistance as required by law or contract.

Current Media Processing, Results and Deletion

When customer-submitted media is analyzed, the temporary active-processing copy used to perform the scan is removed after the analysis is completed. Temporary active-processing copies of customer-submitted media are removed after the analysis is completed. Unless a different period is agreed in an applicable Order Form or Data Processing Agreement, or retention is required for legal, security, fraud-prevention, billing-reconciliation or dispute-resolution purposes, stored customer-submitted media, Results, derived artifacts, reports and extracted media metadata are deleted or irreversibly de-identified from active systems within 28 days after the Result is generated. Minimal non-content transaction and audit records — such as task and organisation identifiers, status and timestamps, the model or category used, amounts charged or refunded, and non-sensitive error codes — may be retained where reasonably necessary for billing reconciliation, analytics and auditability. Residual copies in encrypted backups are isolated from ordinary operational use and removed through the ordinary backup-rotation process within 90 days of deletion from active systems; backups are not restored except for disaster-recovery or security purposes, and any restored content is returned to the deletion workflow. Customers should not rely on Verifiction as a permanent storage, backup, archive or evidence-preservation service and are responsible for maintaining any original media or Results they wish to preserve.

Model Use, Service Providers and Limited Access

Customer media is not currently used to train or fine-tune general-purpose or commercial detection models. If Verifiction offers a separate research or model-improvement program in the future, customer media will be used only under the disclosures, consent and contractual authorization applicable to that program. Customer media is not sent to an outside general-purpose artificial-intelligence model company for analysis. Contracted infrastructure providers may host, store, transmit or compute on submitted content solely to provide the Services and are restricted from using it for independent purposes where required by contract. Authorized Verifiction personnel may access account-level and operational information for support, security, billing and administration. Access to customer media or specific Results is limited to circumstances where it is technically necessary, authorized, requested for support or required by law.

14. Changes to Our Privacy Notice

We keep this Privacy Notice under regular review and may update it to reflect legal requirements, technical developments, new Services or changes in our information-handling practices. We will post the updated Privacy Notice and revise the Last Modified date. We will provide additional notice or obtain consent where required for a material change. Continued use after an update may constitute acceptance where permitted by law.

15. Notice to Law Enforcement

Law-enforcement officials seeking disclosure of records must serve valid legal process issued by a court or other authority with jurisdiction over Verifiction Technologies Inc. Requests should identify the requesting authority, the legal basis, the records sought, the relevant account or transaction and contact information for the responsible official. Legal process should be sent to support@verifiction.com and, where formal service is required, to Verifiction Technologies Inc. at its registered address in British Columbia, Canada. We reserve all rights and objections available under applicable law and may require formal service where appropriate.
